This site and its subjects (the "Site") is the exclusive property of CryptoHamsters, a limited liability Company. All rights are reserved.

These Terms of Use and its general requirements so that the token trading platform and electronic game "CryptoHamsters" (the "Terms of Use") are used aim to define the rules to be followed by the Site, without prejudice to the concomitant application of the current Legislation.

CryptoHamsters is a distributed program that works on the Ethereum platform, it using specially designed smart contracts (each one has a "Smart Contract") to allow users to have, transfer, and develop digital tokens in a fun way via a website. These digital tokens are mentioned in the Terms of Use as Hamsters, which are genetically unique digital hamsters that can be viewed on a website in regards to which the user can interact (the "Site"). Smart Contracts and the Site are collectively referred to the Terms of Use as the "Site". By using the Site, users can view their Hamsters.

THE CRYPTOHAMSTERS IS A PLATFORM SITE THAT PRESENT DIGITAL TOKENS AND ELECTRONIC GAME. THE CRYPTOHAMSTERS ARE NOT, ANY WAY. RESPONSIBLE FOR THE GOODS AND/OR SERVICES ADVERTISED BY THIRD PARTIES ON THE SITE.

The Smart Contracts that are located in the main Etherem network of the Ethereum platform and they are consisted of services offered by our suppliers, since we understand that you agree to the rules pre-established in the Smart Contracts by using the Site.

Some operations present in the Smart Contracts are banned by rules pre-established in Smart Contracts. We consider the user has entire understanding of these rules by accessing the Site, what makes clear that any change in these rules are the sole responsibility of the administrator of the Smart Contracts platform.

REGISTRATION AND ACCESS TO THE SITE MEAN ENTIRE ACCORDANCE TO THE PROVISIONS OF THESE TERMS OF USE. IF YOU DO NOT AGREE WITH ANY PROVISION HERE, YOU DO NOT ACCESS THE SITE.

ACCESS AND REGISTRATION

The mere access to the Site is free, from any device that has Internet access. However, so that the CryptoHamsters electronic game is used, the user must have the "MetaMask" application installed and authenticated in his browser, besides having an Ethereum wallet with at least a valid public address. If you perform any operations on the site using a public address of a valid Ethereum wallet, you agree that you are the holder of that wallet or have the necessary permission from its holder.

The Site is intended for individuals over the age of 16 (sixteen). The access of the Site by minors under the age of 16 (sixteen) is permitted as long as they are assisted and represented by their legal representatives during the whole access.

For registration and use all the subject on the Site, users must provide personal information, such as name, address and e-mail address, as well as other related personal data, such as the public address of the Ethereum wallet, na essential procedure so that the user can interact with Hamsters. All personal data are provided voluntarily or from automated procedures are subjected to security measures to avoid unauthorized access, use, and disclosure and is subject to the provisions present in the Site's Privacy Policy.

THE USER IS ENTIRELY RESPONSIBLE FOR THE VERACITY AND ACCURACY OF THE INFORMATION SUPPLIED. IT IS EXTREMELY IMPORTANT THAT THE USER KEEPS HIS DATA CORRECT AND UPDATED, IN ORDER TO ENJOY ALL THE BENEFITS PROVIDED BY THE SITE.

Simplified Registration. In a alternative way and at your discretion, you can do a simplified registration, by registering only your e-mail address. However, to be able to interact with the Site in its amplitude, it is essential that the user do the full registration later, including all the necessary data. Users can also do the Simplified Registration through your Facebook login; in this case, the user allows CryptoHamsters access, store and use the information provided by Facebook to register on the Site. Facebook is a site powered by the Company Facebook Inc. CryptoHamsters has no connection with Facebook Inc., in addition to not having any responsibility, nor guarantee in any way, the products and/or services provided by that company.

The CryptoHamsters ensures the right to check the accuracy of the data reported by every user during his registration, beforehand excluding all of users who provide fake data, as well as incomplete or incorrect information about the required fields.

Registrations made on the Site are individual and non-transferable. The user will be solely responsible for safing and using passwords generated by the Site, and they must report the CryptoHamsters about loss, mislaid or theft. The CryptoHamsters will not be responsible for registrations and accesses made by third parties not authorized by the user, in the case of these accesses have been made with the correct password, or by misuse of third party applications on the Site.

THE CRYPTOHAMSTERS ENSURES THE RIGHT TO SUSPEND OR CANCEL ANY REGISTRATION, AT ANY TIME, IN CASE OF FRAUD, PARTICIPATION FOR BENEFITING OR TAKING ADVANTAGE IN AN ILLICIT MANNER, OR FOR NON-COMPLIANCE WITH ANY OF THE REQUIREMENTS OF THESE TERMS OF USE OR THE APPLICABLE LEGISLATION, WITHOUT ANY COMPENSATION BEING OWED TO THE USER.

HOW THE TRADING PLATFORM WORKS

From Smart Contracts to enter the initial generation of CryptoHamsters, an initial figure of Hamsters (that will be available for purchase) will be released on the day the Site is first launched. Then, additional Hamsters will be released at varying intervals, which can be purchased via the third-party website.

Unique and surprising lines can be expressed when new Hamsters are bred based on the right combinations

For every operation performed on the Smart Contracts, the CryptoHamsters platform charges a small percentage, an amount that contributes to keep the service working.

RESPONSIBILITY AND RIGHTS

TO ISSUE PROMOTIONAL HAMSTERS, SINCE CRYPTOHAMSTERS MAY ALSO, AT ITS SOLE DISCRETION, ISSUE SPECIFIC REGULATIONS CONSISTED OF TERMS AND REQUIREMENTS ABOUT SUCH HAMSTERS.

IT CONSIDERING THAT THE SERVICES PROVIDED ON THE SITE ARE PROVIDED EXCLUSIVELY BY THE DEVELOPERS, CRYPTOHAMSTERS HAS NO PARTNERSHIP, MANDATE, FRANCHISE, PARTNERSHIP OR BUSINESS RELATIONSHIP WITH THE ETHEREUM PLATFORM, IN ADDITION NOT TO BEING RESPONSIBLE, UNDER ANY CIRCUMSTANCES, FOR ANY DAMAGES, MATERIAL OR MORAL, CAUSED BY THIS SYSTEM, EXEMPTING CRYPTOHAMSTERS FROM ANY RESPONSIBILITY OR OBLIGATION RESULTING FROM SUCH RELATIONSHIP, INCLUDING THE CORRECT PROCESSING OF SALES MADE THROUGH THE ETHEREUM PLATFORM.

IT CONSIDERING THE INHERENT CHARACTERISTICS OF THE INTERNET PLACE, CRYPTOHAMSTERS IS NOT RESPONSIBLE FOR BLOCKS OR CONNECTION SUSPENSIONS CAUSED BY UNFORESEEN CIRCUMSTANCES OR FORCE MAJEURE, SUCH AS LOST, INCOMPLETE, INVALID OR DAMAGED DATA, AS WELL AS INTERVENTIONS BY HACKERS AND MALICIOUS SOFTWARE WHICH CRYPTOHAMSTERS DOES NOT HAVE DIRECT OR INDIRECT CONTROL.

THE CRYPTOHAMSTERS SHALL ALSO NOT BE RESPONSIBLE FOR COMPUTER TRANSMISSIONS THAT ARE INCOMPLETE OR FAIL, AS WELL AS FOR TECHNICAL FAILURE OF ANY NATURE, INCLUDING, BUT NOT LIMITED TO, THE ELECTRONIC POOR WORKING OF ANY NETWORK, HARDWARE OR SOFTWARE, THE AVAILABILITY AND ACCESS TO THE INTERNET, AS WELL AS ANY HUMAN, TECHNICAL OR OTHER FAILURE THAT MAY OCCUR DURING THE PROCESSING OF THE INFORMATION ON THE SITE, BESIDES FAILURE OR UNAVAILABILITY OF THE SITES, ESPECIALLY THE ONES RELATED TO THE MEANS OF PAYMENT USED, THEREFORE DISCLAIMING ANY RESPONSABILITY RESULTING FROM SUCH FACTS AND/OR ACTS.

The CryptoHamsters is a website that provides views of digital tokens and electronic gambling, and THEREFORE DISCLAIMS any misunderstanding related to the sale of real hamsters.

INTELLECTUAL PROPERTY

The entire rights of the Site, with the exception of the public ETHEREUM system and the SMART CONTRACTS, Cookies and CryptoHamsters technology, including related to text, images, layouts, skins, codes, trademarks, databases and other subjects, are the exclusive property of CryptoHamsters. The improper use of any content or brands presented on the Site is expressly prohibited. No copying, distribution, display or disclosure of the Site shall be construed as a restriction or waiver of CryptoHamsters' rights in the Site.

The execution of any reverse engineering techniques on the Site is expressly banned, as well as the development of any malicious programs, techniques and/or software that may alter or copy the Site and/or Cookies, even if it is for the purpose of introducing technical and/or procedural improvements, is expressly forbidden and the offender will be subject, in this case, to the penalties and sanctions provided by law.

All the offers, diffusions, brands, texts and subjects of the Virtual Stores, transmitted through the Site, are the property of their respective owners. The misuse of any content or brands presented on the Site is expressly banned.

GENERAL PROVISIONS

The CryptoHamsters ensures the right to change the conditions of these Terms of Use at any time, by reporting previously to their users.

The omission or tolerance of CryptoHamsters to demand strict compliance with the conditions of these Terms of Use shall not, in any event, constitute a novation or waiver, nor shall it prevent CryptoHamsters from exercising these rights at any time.

The questions and situations not presented in these Terms of Use will be first settled by CryptoHamsters and, if they persist, should be submitted to the public agencies members of the National System of Consumer Protection.

The CryptoHamsters may also stop the working of the Site at any time, by reporting previously to their users, as well as terminate, immediately, access to the Site by users who violate any conditions under these Terms of Use or any applicable law, without any compensation is due.

The CryptoHamsters ensures the right, at any time, without notice, suspend the site to fix any problems that may violate any rights established by these Terms of Use, as well as apply routine maintenance on the Site, as well as perform pre-set workings directly on the Smart Contracts, workings that aim to improve the quality of use of the Site and fix bugs that eventually appear. As a last resort, CryptoHamsters may even perform the exchange of these Smart Contracts if necessary to correct a critical bug that will also violate any rights established by these Terms of Use.
